These Terms govern your access to and use of FairShare, a bill-splitting and expense management service. Please read them carefully.

1. Acceptance of Terms

By accessing or using FairShare (the "Service"), you agree to be bound by these Terms & Conditions and any additional terms referenced herein. If you do not agree, do not use the Service.

2. Eligibility

To use FairShare you must be at least 13 years old. If you are under 18, you must have parental or guardian permission to use the Service where required by law. We may refuse service, terminate accounts, or change eligibility requirements at our discretion.

3. User Content & Responsibilities

You are responsible for the content you submit, share, or upload through the Service ("User Content"). This includes messages, images, receipts, notes, and any other data you provide.

  • By submitting User Content you grant FairShare a non-exclusive, worldwide, royalty-free license to host, store, and display that content as necessary to provide the Service.
  • Do not submit private personal data about other people (for example sensitive identifiers or private financial information) without their consent.
  • Do not attempt to impersonate others or falsify information.

4. Payments, Balances & Liability

  • FairShare helps groups calculate and track shared expenses but is not a bank, payment processor, or escrow agent. We do not hold funds for users.
  • Users remain responsible for settling debts and payments with other group members outside the app (unless the Service provides and you use integrated payment features through third-party providers).
  • We are not liable for disputes between users about who owes what. We provide tools and records to help resolve disputes but do not arbitrate them.

5. Prohibited Content & Conduct

To keep FairShare safe and welcoming, you must not use the Service to create, upload, or share content that:

  • Contains hate speech, racist, sexist, homophobic, or discriminatory remarks targeting a protected class.
  • Promotes, depicts, or threatens violence, criminal activity, or self-harm.
  • Contains nudity, explicit sexual content, or sexual activity. This includes images or text that describe or suggest nudity or sexual acts.
  • Includes graphic or pornographic images, or written sexual content intended to arouse.
  • Reveals sensitive personal data (e.g., government ID numbers, financial account numbers) about others without consent.
  • Includes harassing, abusive, or bullying content directed at an individual.
  • Facilitates fraud, phishing, or other deceptive financial schemes.
  • Violates applicable laws or the rights of others (including intellectual property).

We may remove offending content and suspend or terminate accounts that violate these rules. Repeat or serious violations may result in permanent ban and reporting to law enforcement where required by law.

6. Privacy & Data

Our Privacy Policy explains how we collect, use, and protect your data. By using FairShare you consent to that policy and the collection, storage, and processing described there.

7. Intellectual Property

FairShare and its licensors retain all rights, title and interest in the Service, including software, designs, trademarks, and content (excluding your User Content). You may not copy, modify, distribute, or create derivative works without express written permission.

8. Termination

We may suspend or terminate your access for violating these Terms or for any other lawful reason. Upon termination, your right to use the Service ends and we may delete or limit access to your account and data consistent with our Privacy Policy.

9. Disclaimers & Limitation of Liability

  • The Service is provided "as is" and "as available." To the extent permitted by law, FairShare disclaims all warranties, express or implied, including merchantability or fitness for a particular purpose.
  • In no event will FairShare be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, even if advised of the possibility of such damages.
  • Some jurisdictions do not allow limitation of liability; where such laws apply, liability will be limited only to the extent permitted by law.

10. Governing Law & Contact

These Terms are governed by the laws of the jurisdiction in which FairShare operates, without regard to conflict-of-law rules. If any provision is found invalid, the remainder will continue in effect.
